Jak już szeroko informowano, 22 października 2021 roku Terraform Labs („TFL”) (prywatna spółka z Singapuru) i nasz CEO, Do Kwon (obywatel Korei Południowej), wnieśli sprawę do sądu federalnego w Nowym Jorku w związku z dwoma wezwaniami do sądu, które Komisja Papierów Wartościowych i Giełd (Securities & Exchange Commission) wydała i próbowała doręczyć Do, gdy ten uczestniczył w wydarzeniu Messari Mainnet w Nowym Jorku 20 września 2021 roku. Główną podstawą skargi jest to, że wezwania są nieważne i niewykonalne, ponieważ SEC nie zastosowała się do własnej zasady, która wymaga specjalnego nakazu Komisji oraz upoważnienia do osobistego doręczenia osobie fizycznej, jeśli jest ona reprezentowana przez obrońcę, a w każdym razie próba doręczenia wezwania Do nie mogła wystarczyć jako doręczenie TFL.
Pomimo wyraźnego nieprzestrzegania przez SEC własnych zasad, SEC wniosła dziś do sądu federalnego własne postępowanie mające na celu wymuszenie zastosowania się do wezwań. W komunikacie prasowym zapowiadającym złożenie wniosku SEC nie odnosi się do nieprzestrzegania własnych zasad, a w swoich dokumentach nie zaprzecza, że nie udało jej się uzyskać konkretnego nakazu upoważniającego do doręczenia wezwania Do.
Ostatecznie sąd zdecyduje, czy SEC działała prawidłowo. Z niecierpliwością czekamy na przedstawienie naszej sprawy przed sądem.
